DMCA Policy for Videos

ProtonTube respects the intellectual property rights of others and expects users of the website to do the same. This Digital Millennium Copyright Act (“DMCA”) Policy explains how copyright owners can report alleged infringements and how ProtonTube responds to such notices.

This policy is adopted in accordance with the Digital Millennium Copyright Act, 17 U.S.C. §512.

If you believe that your copyrighted work has been copied, uploaded, or distributed on ProtonTube in a way that constitutes copyright infringement, you may submit a written DMCA takedown notice.

Your notice must include the following information:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the allegedly infringing material, including URLs sufficient to locate it
  • Your name, address, telephone number, and email address
  • A statement that you have a good-faith belief that the use is not authorized
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf

How to Submit a DMCA Notice

Counter-Notification Procedure

If you believe that content you uploaded was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification.

Your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the removed material and its previous location
  • A statement under penalty of perjury that the material was removed by mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement consenting to the jurisdiction of a federal court in your location or where ProtonTube operates

Upon receipt of a valid counter-notification, we may restore the material unless the original complainant files a court action.

Repeat Infringer Policy

ProtonTube reserves the right to terminate user accounts that are determined to be repeat infringers, in accordance with applicable law.

Misrepresentation Warning

Any person who knowingly submits a false DMCA notice or counter-notification may be liable for damages, including costs and attorneys’ fees.
