The "Protecting Americans from Foreign Adversary Controlled Apps Act" was signed into law by Vice President Joe Biden, and TikTok was given a period of six months to separate itself from its Chinese parent company, ByteDance. Rather than comply with the law, the corporation decided to challenge it by filing a petition with the Supreme Court, arguing that the measure in question infringed its rights under the First Amendment. The high court, which had just a short period of time to deliberate on the matter, came to a decision that was unanimously against the application.

TikTok must be removed from either the Apple App Store, the Google Play Store, or any other app marketplace in order to comply with the ban. If they fail to do so, they will be susceptible to a fine of $5,000 for each person in the United States that installs the program. In the beginning of the week, officials from the White House stated that the ban would not be enforced during the final hours of President Joe Biden's tenure in office. Apple has verified that TikTok and other ByteDance applications will no longer be available for download from the App Store in the United States as of January 19, according to a statement that was posted on its help website regarding the ban. "Apple is obligated to follow the laws in the jurisdictions where it operates," according to the organization's statement.

Despite the fact that there have been numerous attempts made to ban TikTok in the United States due to worries around surveillance, this is the first time that one has been successful, at least temporarily. It is ironic that President-elect Donald Trump, who was a prominent proponent of a ban during his first term in office, is the only hope that TikTok has of surviving following his second inauguration. If an extension is granted, it is not entirely apparent what type of solution the corporation might come up with in order to continue operating in the United States after all. According to CNBC, Perplexity AI has apparently launched a bid to merge with the operations of TikTok that are located in the United States. Other individuals, such as the financier Kevin O'Leary, who is famous for his appearance on the show Shark Tank, have also made proposals or showed interest in purchasing the service.
